Premise and effectiveness of General Conditions
These General Terms of Sale (below “General Terms”) are set by Legislative Decree No. 206/05, and are concerned with the sale of products and services, carried out remotely and made available, via the internet, through the website www.vinivaccaro.com, shop section (below, “The Site”).
This Site and its products are property of:
VINI VACCARO AGRICOLA SRL (below, “ The Seller”) CDA COMUNE SNC
The sale is intended exclusively for the consumer (below, “the consumer”), aged over 18 years, as required by current laws. The Consumer who accesses the Site to make purchases is required, before the submission of the order, to view these General Terms. When the order is sent, they are understood to be accepted.
Way of how the contract is stipulated
In the Shop section of the above mentioned Site, the characteristics and the prices of the products for sale are shown. The Consumer for the purchase of the products should add the same to the cart, and after viewing and accepting the General Conditions and the Privacy Police, fill out the form in electronic format, select the desired payment method and proceed to submit the order. The consumer’s submission of the order by the consumer has a contractual proposition value. The contract between Seller and Consumer is understood to be included with the acceptance of the order. The consumer will receive an email containing: the details of the Consumer and the order, the price, the shipping prices and any additional extra charges, the payment methods, the address where the product will be delivered and the billing one. The Consumer will check the E-mail of the delivery and in case, he should encounter any errors in the order, he could immediately contact the Seller to the email:email@example.com. call the following number: 39 329 5965313 , or send a WhatsApp message.
Following the receipt of the order, the Seller will be able to make the money available. If one or more products are not available, the consumer will be given a timely notice by e-mail and the same may decide whether to proceed or cancel the order. When the order is shipped, the Salesman will send the invoice by email.
The essential features of the products offered by the Seller are presented with special product cards, visible directly on the Site. However, images and colours of the products offered on sale may not be comparable to the real ones due to the Internet browser and the monitor used
All products are shipped with eligible packaging. If the cartons are damaged, tampered with or with a break-in, the Consumer must accept the delivery with reservation, filling out the appropriate form, directly to the courier. The Consumer, who has been informed of the damage to the product, will then notify the Sales company, which will replace the product partially or completely of the damaged product or a reduction in the amount paid.
All prices of the products on display and indicated within the Shop section of the Site are expressed in euros and including VAT
Method of payment
The consumer will be able to pay for the order and its delivery costs through:

Time and delivery methods
The Seller will deliver the products ordered, by courier to the address provided by the Consumer.
Delivery times vary from 5 to 7 working days from receipt of payment, Monday to Friday, excluding Saturdays and holidays. The Seller is not responsible for or delays that are not foreseeable and not attributable to it. Shipping modes and costs are clearly indicated and well highlighted in the purchase process.
Right of withdrawal
The Consumer has the right to withdraw from the purchase contract for any reason, without the need to provide explanations and without any penalty.
To exercise this right, the Consumer must send the Seller a communication within 14 days from the date of receipt of the products. This communication must be sent by registered letter with return receipt addressed to Vini Vaccaro Agricola Srl C / da Comune SNC 91020 Salaparuta (TP) or by email to the following address: firstname.lastname@example.org
Once the communication has been received, the Seller will open a procedure for the management of the return and communicate to the Consumer the instructions on how to return the products, which will take place by courier indicated by the Seller himself. In case of exercise of the right of withdrawal, the Seller fully bears the shipping costs for returning the products. The right of withdrawal is governed by the following conditions:
I. The right applies to the product purchased in its entirety; therefore, if the product is made up of several components or parts, it is not possible to exercise the withdrawal only on part of the product
II. In case of exercise of the right of withdrawal, the Seller will refund the Consumer the full amount of the returned goods, including any shipping costs, within 14 days from the date on which the notice of withdrawal was received, without prejudice to the Seller’s right to suspend the payment of the refund until the actual receipt of the products. The refund will be made using the same payment method used by the Consumer, unless he has specifically requested a different
III. In order to guarantee the free return, the products must even be returned in the same box in which they were received or at least with suitable packaging.
With reference to the cases of exclusion of the withdrawal, the Consumer, in particular, is informed and accepts that among the products that “risk to deteriorate or expire rapidly” are enclosed all food products (including wines, spirits and food), as the characteristics and the qualities of these types of products are subject to alteration also as a consequence of an inappropriate storage.
Therefore, for hygiene and consumer protection reasons, the right of withdrawal is applicable only for products purchased on the Site that can be returned to the Seller and put back on the market without endangering the health of Consumers. In cases of exclusion of the right of withdrawal, the Seller will provide to return the purchased products to the Consumer, charging the shipping costs to him.
Errors and limitations of liability
Information relating to the products, provided through the Site, are constantly updated. However, it is not possible to guarantee the complete absence of errors for which the Seller cannot therefore be held responsible, except in cases of willful misconduct or gross negligence. The Seller reserves the right to correct errors, inaccuracies and omissions even after an order has been sent, or to modify or update the information at any time without prior notice, without prejudice to the rights of the Consumer pursuant to General Conditions and of the Consumer Code.
Except for willful misconduct or gross negligence, any Consumer right to compensation for damages or the recognition of compensation is excluded, as well as any contractual or non- contractual liability for direct or indirect damage to persons or things, caused by the non- acceptance or evasion, even partial, of a order.
The responsible consumption of alcohol excludes any liability, except for willful misconduct or gross negligence, in the case of purchase made by minors under 18 years.

Treatment of personal data
For any civil controversy between the Seller and the Consumer, dependent on the regulatory interpretation and conditions here submitted, the mandatory territorial jurisdiction is of the judge of the place of residence or domicile of the Consumer, if located in the territory of the Italian State. In all other cases, the territorial jurisdiction is of the Sciacca Court, any other competent Court is excluded.
